These policies govern all registrations, payments, and participation across all services offered by Tarun Sardesai Golf Private Limited (TSG), including long-term academic programs and individual tournaments or events.
Binding Agreement precendence Disclaimer
This website policy page contains general and supplementary terms concerning long-term golf coaching programs (including residential, non-residential, full-time and visiting arrangements). However, the specific, comprehensive terms and financial obligations for these programs are exclusively governed by the Training Services Agreement signed directly between TSG and the Parent/Guardian. In the event of any conflict, discrepancy, or ambiguity, the terms and conditions outlined in the signed Agreement shall take absolute precedence over the information presented here.
1. Scope, Enrollment and Contract Basis
This section defines the types of services offered and the legal basis for participation.
A. Service Differentiation
These policies apply to two distinct service types:
- Program Enrollment: Structured, long-term coaching (e.g., residential, non-residential, full-time, and visiting programs) governed by a signed Training Services Agreement. This includes any and all golf coaching programs being administered at the TSG Academy premises in Kolar, Karnataka as well as any other locations where golf coaching programs are available and operated by TSG Academy.
- Standalone Services: Individual events, tournaments, short camps, or single-lesson bookings not requiring the full agreement.
B. Minors and Contracting Party
For all participants under the age of 18, the Parent or Legal Guardian is the contracting party and must complete the registration, sign the necessary agreement, and is legally responsible for adherence to these policies and all financial obligations.
C. Legal Precedence
For Program Enrollments, this policy page is supplementary. The specific terms and conditions set forth in the signed Training Services Agreement between TSG and the Parent/Guardian shall always take precedence in case of any conflict.
2. Fees, Payments, and Financial Terms
This section establishes all financial obligations, including fees, payment due dates, and the handling of non-attendance.
A. Program Fees (Residential, Non-residential, Full-time, and Visiting Programs)
- Taxes Exclusive: All Program Fees are quoted exclusive of applicable taxes. The final invoice amount will include the Program Fee plus all current statutory taxes (e.g., GST).
- Fees Payable: The Parent/Guardian is required to pay the specified fees plus applicable taxes by the Due Date indicated in the official invoice.
- Non-Offsetting of Fees: Once paid, fees for a specific term will not be set off or deducted against subsequent months or periods.
- Non-Attendance Obligation: Non-attendance, leave, or sabbatical taken by the Student during a paid term does not relieve the Parent/Guardian of the obligation to pay the full program fees for that period. No refunds or extensions will be provided for days or weeks missed.
B. Standalone Event Entry Fees (Tournaments)
- Taxes Exclusive: The entry fee for all standalone events and tournaments is a variable amount exclusive of applicable taxes. The final amount due at registration will include the fee plus the current statutory taxes.
- Exclusions: The entry fee specifically excludes the following costs, which must be borne separately by the participant or Parent/Guardian, unless explicitly stated otherwise in the event particulars:
- Caddy fees.
- Costs associated with practice rounds.
- Refreshments, snacks, and any meals not explicitly listed as part of the event package.
- TSG Fees Only: The entry fee covers only the Tournament Organising Fee and associated taxes. Any additional charges levied by the host golf club (e.g., green fees, buggy fees) must be paid directly to the club unless explicitly stated otherwise.
C. Suspension and Termination for Non-Payment
- Service Suspension: TSG Academy shall be entitled to suspend all the services, except the residential and dining services, for a period of 7 (seven) days starting from the expiry of the Due Date set out under Annexure 1 (the "Suspension Period"), in the event that the Parent/Guardian fails to pay the fees by the Due Date. In the event of non-payment of fees beyond the expiry of the Suspension Period, TSG Academy shall be entitled to suspend the residential and dining services as well and the Student will not be allowed to access the premises of TSG Academy.
- The Parent/Guardian will be provided with an additional period of 60 (sixty) days commencing from the expiry of the Suspension Period (“Extended Suspension Period”) to settle the outstanding payments. Once the payment is made, TSG Academy shall resume the provision of services to the Student in accordance with this agreement. In the event of non-payment of fees within the Extended Suspension Period, TSG Academy reserves the right to terminate this agreement in accordance with section 7 of the agreement.
- Termination and Forfeiture:
- The agreement may be terminated at any time:
- by TSG Academy by giving the Parent/Guardian 15 (fifteen) days' notice in advance; or
- by the Parent/Guardian by giving one (1) month’s notice in advance, in writing, to TSG Academy.
- This agreement may be terminated by TSG Academy, immediately upon provision of written notice to the Parent/Guardian for any breach of the terms of the agreement, including, without limitation, for breach of the terms of the Fees and Payment clause in the agreement and the Code of Conduct, by the Parent/Guardian or the Student.
- Consequences of Termination:
- If the agreement is terminated by the Parent/Guardian with one (1) month’s notice or by TSG Academy immediately upon provision of written notice to the Parent/Guardian for any breach of the terms of the agreement, the fees paid by the Parent/Guardian shall not be refunded and shall stand forfeited;
- If the agreement is terminated by TSG Academy by giving the Parent/Guardian 15 (fifteen) days' notice in advance TSG Academy may, at its sole discretion, refund the fees for the unexpired Term, after deducting the costs of relevant supporting services listed in the agreement and used in the course of training the Student including a 3 month management fee. The refund will be initiated 3 months after the Student ceases to be part of TSG Academy.
- Upon termination of the agreement, the Student shall return all the property of TSG Academy that is in his/her possession.
- The Parent/Guardian and the Student acknowledge that upon termination of the agreement, the Student will neither be allowed to access the premises of TSG Academy nor avail any services made available by TSG Academy (directly or indirectly).
- If the agreement is terminated by the Parent/Guardian by giving one (1) month’s notice in advance, in writing, to TSG Academy or by TSG Academy, immediately upon provision of written notice to the Parent/Guardian for any breach of the terms of the agreement, all fees that Parent/Guardian are obligated to pay under this agreement shall become immediately due and payable irrespective of the due date set forth in the agreement. The Parent/Guardian hereby agrees and acknowledges that termination by the Parent/Guardian by giving one (1) month’s notice in advance, in writing, to TSG Academy or by TSG Academy, immediately upon provision of written notice to the Parent/Guardian for any breach of the terms of the agreement shall not relieve them of their obligation to pay all the unpaid fees set forth in the agreement.
3. Conduct, Risk, and Liability
This section outlines the rules of conduct and the crucial legal limitations on liability.
A. Warranties and Acknowledgement of Risk
- No Guarantee of Success: The Parent/Guardian acknowledges that success in sport is highly variable and dependent on circumstances that are outside the reasonable control of TSG Academy and its trainers. Therefore, TSG Academy does not guarantee any sporting success outcomes as a result of the Students' participation in the Program.
- Student and Parent/Guardian Undertakings (Injury): The Parent/Guardian agrees and acknowledges that TSG Academy shall not be responsible for any injury that the Student may sustain on account of any circumstance that does not involve the wrongful or negligent instruction of any trainer or Specialist of TSG Academy.
B. Instructional and Disciplinary Authority
- Instructional Control: The Parent/Guardian shall not have the right to dictate the terms, timing or schedule of any instruction and training provided by coaches and trainers.
- Code of Conduct: The Student must be bound by and strictly adhere to the TSG Code of Conduct. Failure to comply is grounds for strict disciplinary action, including expulsion from the Program or disqualification from an event.
- Misconduct Reporting: If the Student feels they are being subjected to treatment that violates the Code of Conduct, they must immediately report it to the designated TSG representative. TSG Academy will be absolved of any responsibility or liability arising from a failure to report such an incident.
C. Tournament-Specific Authority
- Governing Rules: All tournaments are governed by the latest Rules of Golf as published by The R&A and USGA, supplemented by the specific Local Rules and the Tournament Committee’s (TC) Conditions of Competition.
- Committee Decisions: The decisions of the appointed Tournament Committee (TC) are final on all matters, including Rules interpretations, handicapping, results, and prize distribution.
- Spectator Conduct: Parents and spectators must adhere to the Code of Conduct, stay off fairways and greens, and are prohibited from giving advice to the participant during the round.
D. Limitation of Liability and Sole Remedy
- Limitation: In no event shall TSG be liable for any special, indirect, punitive, or consequential loss or damage. The maximum aggregate liability of TSG for any and all claims shall not exceed that portion of the fees paid by the Parent/Guardian for the unexpired duration of the training period during which the claim may arise.
- Sole Remedy: The Parent/Guardian's sole remedy available under this agreement, in any and all circumstances, shall be to withdraw the Student from the Program and collect any refund that, at the sole discretion of TSG Academy, is found to be due.
4. Weather, Course Conditions and Force Majeure (applicable only to Tournaments and Events)
- Suspension Protocol: Play may be suspended due to dangerous situations (e.g., lightning) or normal suspension (e.g., unplayable course). Players must comply immediately with all horn signals or face disqualification.
- Service Guarantee: If an event is shortened or cancelled due to adverse weather or unforeseen circumstances:
- If the event has not commenced, participants will be offered a full credit or a refund at the discretion of the TC.
- If the event has commenced and a stipulated number of holes have been completed, the event will be deemed final, and no refunds or credits will be issued.
